1.1 These general terms and conditions (AGB) apply to all orders that consumers and entrepreneurs (hereinafter "customer" or "you") make via the online shop of Swiss Tallow Deutschland GmbH (hereinafter "Swiss Tallow", "We" or "us"). 1.2 Consumers within the meaning of this terms and conditions is every natural person who concludes a legal transaction for purposes that cannot be attributed to either their commercial or independent professional activity (§ 13 BGB). The entrepreneur is a natural or legal person or a legal partnership that acts in the exercise of their commercial or independent professional activity when the legal transaction is concluded (§ 14 BGB). 1.3 Our online shop is operated via the Shopify Inc.
2.1 The product representations in the online shop do not represent a legally binding contract, but a request for ordering. By clicking the "Order" button, you submit a binding order. 2.2 We will immediately send you an order confirmation by e -mail, in which your order will be listed again. This does not yet be accepted. 2.3 The offer is accepted either by an express order confirmation by e -mail or by delivering the goods to the delivery address you specified.
3.1 The prices displayed include the statutory VAT and plus shipping costs, unless otherwise stated in the ordering process. 3.2 Shipping costs are shown in the shopping cart before completing the order. 3.3 The payment is made either by credit card, SEPA direct debit, PayPal or other means of payment offered in the order process. 3.4 In the event of a delay in payment, we reserve the right to charge reminder fees or to withdraw from the contract.
4.1 We only deliver within Germany, unless a different delivery region is given in the ordering process. 4.2 Unless otherwise stated, the delivery time is 2–5 working days after receipt of payment. 4.3 If not all articles of an order are in stock, we deliver partial deliveries for you at no additional cost.
5.1 Consumers have a legal right of withdrawal (§ 355 BGB). You can find the details of the revocation in our Cancellation policy. 5.2 The right of withdrawal expires if the goods have been inseparable from other goods according to their nature. 5.3 The right of withdrawal does not exist for contracts for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery (Section 312g (2) No. 3 BGB).
6.1 The legal warranty rights apply (§§ 434 ff. BGB). In the case of defects, consumers have the right to subsequent performance (rectification or replacement delivery). 6.2 For entrepreneurs, the warranty period is one year from the delivery of the goods. 6.3 Our liability for damage, regardless of the legal reason, is limited to the typical, predictable damage - except for violation of life, body, health or gross negligence.
As far as permissible, we exclude all tacit guarantees, in particular guarantees of market accessibility or suitability for a specific purpose.
8.1 You are obliged to keep your account information up to date. 8.2 You can only exercise a right of retention if your counterclaim is based on the same contractual relationship.

10.1 If you send us feedback or comments, agree that we can use, edit and publish them free of charge.
11.1 For all legal relationships, the law of the Federal Republic of Germany applies to the exclusion of the UN sales law. 11.2 If the customer is a businessman, a legal entity under public law or a special fund under public law, is the exclusive place of jurisdiction for all disputes from this contract in Essen.
12.1 We reserve the right to adapt these terms and conditions at any time. You can always find the current version in our online shop. 12.2 In the event of changes that are disadvantageous for you, we will inform you in good time. Your continued use of our shop is considered approval of the new conditions.
